Any and all use of this service is subject to the following terms and conditions: All dialup accounts are single-user accounts. This means that only one login from your account is allowed at a time, and the owner of the account (or their immediate family) is the only person allowed to use that account. It shall be the responsibility of the customer to maintain the secrecy and security of their account password at all times. The password will be required to facilitate any changes or requests for information regarding the account, and must be carefully protected by the customer. No passwords will be disclosed by telephone, postal letter or other means, except in person with sufficient and acceptable confirmation of ID of specific account holder only. Our dialup accounts are active use accounts only. This means that they are *not* dedicated lines, and customers should not leave their systems dialed in, online and unattended. Users who find themselves online for extended periods of time should contact our Sales department about obtaining a dedicated line connection. All dial up accounts will be limited to 8 hours online per session, with at least one hour total offline time per 9 hour segment. Accounts may be temporarily or permanently terminated if in violation of this term, subject to administrator review. All email accounts are limited to 100 Meg total server storage. All LiveWire accounts are limited to total downloads of 5 gigabytes (5000 megabytes) of data per calendar month. All usage in excess of 5 gigabytes in any given calendar month will be charged an additional $10 per gigabyte or portion thereof per month for any and all usage over the first 5 gigabytes. All invoices are posted on the 1st day of each month and due by the 15th, and subject to automatic system disconnect if balance remains unpaid 7 days following the due date. If you are paying by check or money order, it is your responsibility to get payment to us on time. Invoices are sent directly to the account holder by e-mail and are also available online. It shall be customer‘s responsibility to regularly read the statement online or by e-mail. If payment is not received by the due date, a late fee may be added. Payments may be made by check, cash or credit card, and may be made online or delivered directly to the office by postal mail or in person. If you choose to pay for your account with a credit card, it is your responsibility to notify the billing department of any changes regarding your payment method, including (but not limited to) changing to another method of payment, informing us of a new card number, or providing a new expiration date. Postal invoices are also available with a $3 additional mailing and handling fee per invoice. Checks returned from our bank will be subject to a returned check fee of $25.00. Customers will be notified upon receipt of a returned check, and will have 10 days from the date of that notice to remit payment for both the returned check and the returned check fee. If payment is not received in 10 days the account will be suspended pending payment as mentioned above. A cashier's check or money order in the amount of the returned check plus the returned check fee of $25.00 will be necessary to reactivate a suspended account. Any check not taken care of within 10 days may be submitted to proceedings of collection or prosecution as allowed by law. If you wish to cancel your account, the account holder may cancel by phone, email or postal letter. If you prepay for multiple months and choose to cancel your account, your service will not be terminated until the end of your prepaid term, or the account may be converted to monthly for the billing term and payments credited toward the monthly charges. We will not issue refunds for periods of past service, only unused portions of your current term may be refunded. North Missouri Internet Services, Inc. is not responsible for any long distance charges a customer may accrue while using our service; it is the responsibility of the customer to ascertain if it is long distance from their location to the service. DISCLAIMERS AND LIMITATION OF LIABILITY North Missouri Internet Services is provided for the convenience of its users on an "as is," "as available" basis without warranties of any kind, either expressed or implied, including but not limited to warranties of title, implied warranties of merchantability or fitness for a particular purpose, non-infringement, security or accuracy. Neither North Missouri Internet Services nor its affiliates, directors, officers, employees or other representatives warrant that the services will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of the North Missouri Internet Services or as to the accuracy, reliability, or currency of any information content, service, or merchandise provided through the use of the services. No oral advice or written information given by North Missouri Internet Services or its affiliates, directors, officers, employees, or other representatives, shall create a warranty; nor shall user rely on any such information or advice. Neither North Missouri Internet Services nor any other party involved in creating, producing, or distributing the North Missouri Internet Services be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use North Missouri Internet Services, including but not limited to reliance by a User on any information obtained from use of any services that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction, or other sources of impairment. We reserves the right to terminate or refuse service to anyone, at any time, for any reason. The policies contained within may change at any time without notice. It is the customer's responsibility to note any changes as they are made. Violations of these Terms of Service or Acceptable Use Policies will result in temporary or permanent suspension of the customers account as deemed necessary by North Missouri Internet Services. By logging in to your account you agree to these terms and condition of use, if these terms are not acceptable you may cancel at any time. Acceptable Use Policies
The customer is responsible for all communications via and all use of North MO Internet
Services. The following constitute Violations of North MO Internet Services Acceptable Use
Policy: IT SHALL CONSTITUTE A VIOLATION OF ACCEPTABLE USE POLICY to intercept or attempt to
intercept E-mail, attempt to access the accounts of others, or attempt to penetrate the
security measures of North MO Internet Services whether or not the intrusion resulted in
corruption or loss of data. This includes, but is not limited to, intentionally seeking
information on, obtaining copies of, or modifying files, email or other data, or passwords
belonging to other users without permission.
IT SHALL CONSTITUTE A VIOLATION OF ACCEPTABLE USE POLICY to use North MO Internet Services
to make fraudulent offers to sell or buy products, items, or services or to advance any
type of financial scam such as "pyramid schemes", "ponzi schemes" or
"chain letters" or other similar schemes. IT SHALL CONSTITUTE A VIOLATION OF ACCEPTABLE USE POLICY to transmit or receive any information, language or data of a lewd, offensive, improper, indecent or adult nature through North Missouri Internet Services by any means at any time, or to attempt to transmit or receive material of this nature through email, file upload or any other means when using, contacting a user, or through any systems of North Missouri Internet Services.
IT SHALL CONSTITUTE A VIOLATION OF ACCEPTABLE USE POLICY to transmit Unsolicited/Bulk
Email: Sending E-mail to users for any purpose other than personal communication,
including but not limited to, transmit unsolicited commercial or bulk email, advertise or
offer to sell goods or services to other users is expressly prohibited. IT SHALL CONSTITUTE A VIOLATION OF ACCEPTABLE USE POLICY to use Long Connections and Multiple Logins: Using a personal dialup account for high volume or commercial use is prohibited. North MO Internet Services are intended for periodic, active use of email, newsgroups, file transfers, Internet chat, games and browsing the World Wide Web. Users may not use the service on a standby or inactive basis in order to maintain a connection. Pinging for the purpose of keeping a continuous open connection is expressly prohibited. Accordingly, North MO Internet Services maintains the right to terminate any user's connection following any extended period of use or inactivity as determined by North MO Internet Services. Violations of any of these Terms of Service or Acceptable Use Policies may result in temporary or permanent suspension of the customers account as deemed necessary by North Missouri Internet Services.
